Terms of Service

Scope

These Terms apply when you use Nexstrive Services websites, apps, and services. By using a service, you agree to these Terms. If a particular app or service provides separate terms, those terms take precedence for the matters they cover. These Terms apply to anything not covered by the separate terms.

If you use a service for an organisation, you confirm that you have authority to accept these Terms on its behalf.

Using our services

You are responsible for your account, the information you provide, and activity under your account. You agree to provide accurate information and keep your login details secure.

You must not:

• use a service for unlawful, fraudulent, abusive, or harmful purposes;
• infringe another person’s rights or upload content you do not have permission to use;
• interfere with a service, bypass its security, or attempt unauthorised access;
• introduce malware or other harmful code; or
• copy, scrape, reverse engineer, or resell a service except where allowed by law or with our written permission.

Your content

You keep ownership of content you submit. You give us and the service providers used for your selected features permission to host, process, copy, and transmit that content only as needed to provide and protect the service, comply with law, and meet these Terms.

You are responsible for your content and for keeping any copies or backups you need.

Payments, subscriptions, and refunds

Prices, billing periods, taxes, renewal terms, and any applicable refund rules are shown when you purchase. Recurring subscriptions continue until cancelled. Cancellation normally takes effect at the end of the current paid period unless the purchase terms or applicable law say otherwise.

Purchases made through an app store or other third-party platform are also subject to that platform’s payment and refund rules. Fees for custom work are governed by the relevant quote, proposal, or agreement.

Our services and ownership

We and our licensors own the services, including their software, design, branding, and related materials. We give you a limited, non-exclusive, non-transferable right to use a service for its intended purpose while you comply with these Terms. No ownership rights are transferred to you.

Third-party services and content are governed by their own terms. We are not responsible for third-party services we do not control.

Availability and changes

We may update, change, suspend, or discontinue a service or feature. We aim to keep our services reliable, but we do not guarantee that they will always be available, uninterrupted, secure, or error-free. We may release updates that are required for continued use.

Disclaimers and liability

Our services are provided on an “as is” and “as available” basis to the extent permitted by law. You are responsible for deciding whether a service and its output are suitable for your needs. Nothing provided through a service is a substitute for professional advice where professional advice is required.

To the extent permitted by law, Nexstrive Services is not liable for indirect, incidental, special, or consequential loss, loss of profits, loss of data, or business interruption arising from your use of a service. Nothing in these Terms excludes liability that cannot legally be excluded.

Ending your use

You may stop using a service at any time and can cancel paid services through the available account or purchase settings. We may restrict or end access if you materially breach these Terms, create risk or harm, or where required by law. Terms that by their nature should continue after termination will remain in effect.

General terms

These Terms are governed by the laws of Malaysia. If a dispute arises, both sides agree to first try to resolve it in good faith. Any unresolved dispute will be subject to the courts of Malaysia, unless applicable law requires otherwise.

We may update these Terms as our services or legal obligations change. We will post the updated version here and change the date above. Your continued use after the updated Terms take effect means you accept them.

If part of these Terms is unenforceable, the remaining terms will continue to apply. Our failure to enforce a term is not a waiver of that term.
